LAST WILL AND TESTAMENT
I, A. J. King of the County of Lincoln and the State of Tennessee, being of sound mind but in feeble health, do make and publish this my last will and testament hereby revoking and making void all former wills made by me at any time.
Item 1st. It is my will that immediately after my death that my body shall be decently interred and my soul shall be saved in heaven.
Item 2nd. I will and devise that so soon after my death as may be practicable, that my funeral expenses and all my debts shall be paid out of the first money coming into the hands of my Executors.
Item 3rd. I will and bequeath to my beloved wife, Isabella, my home place or farm consisting of about two hundred and sixty acres to be managed and controlled by her during her natural life or widowhood, together with all the stock and farming implements of the farm and also that she superintend the education of all my younger children until they are made equal to the older ones in point of education.
My son, Sanford, being seriously afflicted and the probabilities is that he will not be able to make a living by manual labor, I desire him to have a better education than the balance of the children, and in case of my wife's death or marriage then my Executors shall superintend the education of those young children as above.
And it is my will that at the death or marriage of my wife, that all my real estate not otherwise disposed of at the time, together with all my personal property shall be sold upon such terms as my Executors may think best and the proceeds when collected be equally
divided between my wife (if she should marry) and all my children. (to wit) Martha E. Armstrong, E. J. King, P. A. Fox, E. J. Delk, M. F. King, J. W. King, Thos. S. King, William A. King, S. J. King, Alice King.
Item 4th. I will and devise that my tract of land containing 62 1/2 sixty-two and a half acres lying on the head waters of Freeman Creek, known as the Merius Jones shall be sold so soon and upon such terms, after my death as my Executors may think best and the proceeds when collected to be divided at that time equally between my children and wife above named, those of age to receive and receipt for their share, that part going to the minor children to be put in at interest and paid out to them as they become of age.
Item 5th. And it is also my will that my Executors shall receive or collect my interest in my father's estate, and equally divide the same among my wife and children as directed in Item 4 of this Will, after retaining four hundred dollars to be expended in building a barn and repairing the dwelling house we now live in.
Item 6th. I will and direct that in order to make my children equal that Martha E. Armstrong, Permilia A. Fox and Eliza J. Delk be charged with $275, two hundred seventy-five dollars each, and that my son, Ephraim J. King be charged $285, two hundred
eighty-five dollars to come out of their shares or the balance of the children to be made equal with them before distribution take place. These charges against the above named heirs is for property already received.
Item 7th. I hereby nominate and appoint my wife, Isabella King, James M. Barham and E. J. King my sole Executors to this my last Will and Testament and if they or any of them should die or move out of the County, then I direct that the County Court shall appoint others in their stead.
