- Following information from James Dotson:
1. John Paine died April 01, 1826 in Garrard County, Kentucky. He married Saran //. She died March 08, 1851 in Madison County, Illinois.
Per Garrard County KY Probate Records, John Pain died April 1, 1826 intestate and the following documents were found: Letter of Administration and Bond, Inventory and Appraisement, and Sale Bill "Know all men by these presents that we Geo Denny and Thomas Kennedy do promise to pay to the Commonwealth of Kentucky the sum of $500 current money the payment of which well and truly to be made we bind ourselves our heirs & jointly and severally firmly by these presents sealed and dated this 17th day of April 1826.
The condition of the above obligation is such that of the said George Denny Administrator of the goods chattel and credits of John Payne deceased to make a true and perfect Inventory of all and singular the goods chattels and credits of the said deceased which have of shall come to the heirs Possession of knowledge of the said Denny or into the hands of possession of any other person or persons for him and the----unto the County Court of Garrard at such time as he shall be required by said Court, and such goods chattels and credits do well and truly administer according to law and further do make a just and true account of his actings and doings wherein when ---- required by the said Court and all the rest of the said goods chattels and credits which shall be found remaining---the account of the said administrator the said being first examined and allowed by the Justices of the said Court for the time being shall deliver and pay unto each persons---as are entitled to the same by law and if it shall hereafter appear that any last will and testament was made by the deceased and the same be proved in court and the Executor obtain a certificate of the proof thereof and the said Geo Denny in such case being required shall render and deliver up his letters of administration then this obligation to be void else to remain in full force and virtue.

Bond County Probate Court, (Book 1, Page 156)
"At a court of probate held for the county of Bond in the town of Greenville. On the first Monday of August 1832 Barnett Paine & Edward Paine minors over the age of fourteen years; came into Court and chose James Clanton of Said County their legal guardian who accepted the trust, and gave Bond as the law Directs: order therefore that Said James Clanton also be appointed guardian for Thomas Paine, John Paine, Abner Paine, Moses Renfrow Paine and Elizabeth Paine minors under the age of fourteen years and children with the above Barnett & Edward Paine of John Paine late of the County of Garrett and State of Kentucky Deceased. ordered therefore; that letters of guardianship to the said James Clanton, which was done in the following form viz.
"I, John Gilmore judge of the Probate for the County of Bond & State of Illinois to James Clanton of the County of Bond and State aforesaid Greetings; Trusting in your care and Fidelity I do by these presents pursuant to the powers and authority to me granted by the Laws of this state, Do nominate and appoint you to be guardian unto the above named minors over fourteen years of age; and also for those above Named Minors under the age of fourteen years; with full power & authority to ask demand & sue for and recover receive and take into you custody all and singular such parts and fractions of Estate as accrues to said Minors in right of their said Father, or which by any other ways or means whatsoever doth of right appertain or belong to said Minors and to manage employ guardianship upon oath, so far as the law will charge you therewith, when you shall be lawfully required and pay and deliver such and so much of the said Estate as shall be remaining upon you accounts, to said minors when they arrive at full age or otherwise as the Judge of Probate by his Decree or sentence according to law shall limit or appoint.
In testimony thereof I have hereunto set my hand and private seal no official one being provided, this 1st monday of august 1832

James Clanton was thus appointed guardian of Barnett Paine, Edward Paine, minors over the age of 14 and for Thomas Paine, John Paine, Abner Paine, Moses Renfrow Paine, and Elizabeth Paine, minors under the age of 14 on August 6, 1832, for the purpose of settling an estate to which their deceased father, John was entitled. Posting a $600 bond to secure James Clanton as guardian were James Clanton, Thomas Hunter and Richard Bently.

to such heirs as are of full age proportional parts of the Monies in your of the Estate of said Pain Deceased and to put to interest the balance as the Law Directs; the above order compiled with the above Date

On September 14, 1835, Sarah Paine was appointed guardian for the six younger children, Barnett had reached age 21. Signing the bond for Sarah was Elisha Paine and James M Gillespie. The text of this order is in the notes for Sarah.
